TERMS and GENERAL CONDITIONS

 

I- Designation of the parties to the contract

 

A-The boat hire company

Canoe Loire Aventure

 

B-The hirer

The hirer is the person of legal age who signs the rental contract. The hirer may not be a minor. The hirer undertakes, for himself/herself and for the persons he/she authorises to use the equipment he/she has hired: to read, accept and respect the present special rental conditions; to inform the persons he/she authorises to use the equipment he/she has hired of the present special rental conditions, and to ensure that they respect them.

 

C- Civil liability insurance

The hirer declares and certifies by signing the contract that he/she and the persons he/she authorises to use the equipment he/she has hired are insured by an insurance policy guaranteeing his/her civil liability.

 

 

 

II- Pre-requisites for the contract

 

A-The age of the hirer and the participants

The rental by any minor is forbidden. Any minor under 12 years of age must be accompanied on the water by an adult.

The hirer remains responsible for the persons he/she authorises to use the equipment he/she has hired.

 

B-The capacities required for canoeing and kayaking

Participants should be able to swim at least 25 metres and immerse themselves.

Adults or legal representatives for participants under 18 must attest to their ability to swim at least 25 metres and to immerse themselves.

The legal representatives of minors are the only fathers, mothers or guardians. When the minor is not accompanied by one of these legal representatives, any hirer wishing to sail with minors must present either a certificate from the legal representative or a certificate from a qualified authority attesting to these abilities.

 

The hirer declares and certifies by signing the rental contract that he/she and the persons he/she authorises to use the equipment he/she has rented can swim at least 25 metres and immerse themselves and have the knowledge, technical skills and experience necessary to carry out the planned nautical course.

III- Object of the contract

 

A-THE EQUIPMENT

 

a-Designation

The boat hire company provides the hirer, according to what is specified in the contract (nature and quantity): boats: canoe(s), kayak(s), individual protective equipment: buoyancy aid(s), navigation accessories: paddles, / containers for the hirer’s personal belongings during navigation.

 

All of the equipment made available to the hirer is in perfect working order and in good condition, in accordance with its purpose and the applicable regulations.

 

b-S pecial conditions of use of the rented equipment

 

The rental contract transfers custody of all the equipment rented to the hirer for the entire duration of the rental period. The rental period begins at the time the hirer takes possession of the equipment and ends at the time the equipment is handed over by the hirer to the boat rental company. If the time of handing over the equipment is exceeded, the corresponding amount will be due on the spot at the end of the activity with an additional charge of

€15.

Canoe Loire Aventure does not have any responsibility whatsoever for loss or damage to the hirer’s belongings.

Canoe Loire Aventure will not be liable for personal injury due to the non-conforming use of the equipment rented by the hirer.

You should be aware that the dry containers supplied by us cannot be guaranteed to be water proof as they are subject to the closure by the user.

 

 

c- Special obligations of the hirer regarding the rented equipment

 

The buoyancy aid(s) / lifejackets should be worn at all times. It must be closed and adjusted when the on the water.

The boat hire company is not responsible for the use of the rented equipment, in particular for the navigation, closing, fastening and supervision of the containers intended to receive the personal belongings of the hirer and those who sail with him.

The hirer remains entirely responsible for all goods carried by himself and the persons he authorises to use the equipment he has hired. The boat hire company cannot be held responsible for the loss, theft or breakage of any property of the hirer and the persons sailing with him, during the course of the nautical journey.

The rented equipment is intended for the sole use of the hirer without the possibility of subletting or lending, even free of charge.

B- NAUTICAL COURSE

 

a-Information on the nautical course and the navigation conditions

The boat hire company offers a range of nautical routes. For each of these routes, he indicates the distance covered, the average duration of the trip (excluding any downtime), the starting and finishing points of the route, the applicable regulations (navigation, traffic, environment), the difficulties and dangers of the nautical routes he proposes.

In the event of unfavourable weather or water conditions the owner may refuse the rental, subject only to the refund of the deposit paid.

The information given by the boat hire company is provided for guidance only and does not restrict the hirer from seeking any additional information he / she deems necessary.

 

b-T he choice of the nautical route

The hirer is free to choose the route that suits him/her and the people he/she authorizes to use the equipment he/she has hired.

The hirer may :

  • Either, freely choose the route that suits him and the persons he authorizes to use the equipment he has rented. The route chosen by the hirer is specified in the rental contract.

 

  • Or use the rented equipment under his own responsibility on any other nautical route not proposed by the boat hire

The hirer declares and certifies that he/she and the persons he/she authorizes to use the equipment he/she has hired have been informed of the regulations, difficulties and dangers of the route he/she has chosen to take.

 

c- Special obligations of the hirer in relation to the execution of the nautical course.

The boat hire company shall inform the hirer of the regulations and signs which apply to the nautical routes, of the land exit routes of journey, the hydrological and meteorological data.

It is advisable to wear closed shoes.

It is forbidden to abandon any equipment on the way. Any abandonment will be invoiced at the price of the rented equipment plus the cost of removal services.

Loss or breakage of equipment will be invoiced additionally. The hirer agrees not to deposit or leave any waste on the way and to return it to the hire company at the end of the trip for sorting and disposal in the containers indicated by the hire company.

 

Except in cases of force majeure, entering, stopping and parking on private plots of land bordering the river, access to which is forbidden by the owner (signs/fences/oral indications), is forbidden, under penalty of contractual, civil or criminal liability on the part of the hirer.

Damage to any public or private property (plots, roads, works, signs, etc.) is prohibited, under penalty of contractual, civil or criminal liability on the part of the hirer.

 

Participants must be considerate to the riverside residants and all other river users.

 

The completion of the water route is the responsibility of the hirer, who acknowledges having been informed of the particular conditions of completion of this route.

IV – Related or complementary services

 

Within the service on a guided tour, the boat hire company undertakes to bring the equipment to the starting point of the tour. Each participant will have to reach the starting point by his own means via the information provided by the company.

 

V- Prices and payment of the service

 

For each course proposed, the boat hire company undertakes to deliver the equipment necessary for navigation and the transport service, when this is included in the product.

 

The loss or breakage of the equipment will give rise to an additional payment specified on the site or at our reception.

 

The hirer undertakes to pay the amount or the balance of all the services before taking possession of the equipment, without discount.

 

Deposits at the time of booking (by email, telephone or post) can be paid by cheque or cash.

 

In the event of unfavourable weather or water conditions, of which he is the sole judge, the boat hire company may refuse the hire. The hirer reserves the right to ask for a deposit before taking possession of the equipment.

 

 

 

VI- Cancellation

 

In case of cancellation by the hirer :

 

-If the hirer cancels less than 7 days before the event, a refund will be made with a 10% deduction from the sale price. (only for groups of more than 8 people)

 

Special cases giving rise to a full and individual refund:

 

-Cases of force majeure: death, hospitalisation, serious illness (on presentation of proof). Please note that for groups, only the people concerned will be reimbursed.

-Orange or red weather alert: rain, flooding; (24 hour weather forecast)

-Flooding duly noted by the water levels of the Loire.

VII – Costs in the event of loss or abandonment of equipment

 

Loss of equipment: Failure to return the rented equipment, for whatever reason, will result in the invoicing of the full value of the equipment in new condition at the public sale price, in addition to the cost of the rental. (price displayed on the site).

 

VIII-Protection of personal data

 

In accordance with the provisions of the French Data Protection Act of 6 January 1978, amended by the Act of 6 August 2004, annexed to the present regulations on the protection of individuals with regard to the processing of personal data, the hirer has a right of access allowing him/her to rectify or oppose the personal data collected by the boat hire company concerning him/her
